Requirements to integrate the Roster of Arbitrators <\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Article 70. Requirements to integrate the Roster of Arbitrators\u00a0<\/b><\/p>

The applicant who wishes to join the Roster of Arbitrators shall certify the compliance of the following conditions:<\/p>

(a)<\/strong> Formally submit your application for enrollment.
(b)<\/strong> Attach your curriculum vitae duly supported, including professional title, academic degrees, awards, publications (books or articles), university teaching experience, as well as professional career general and specialized that supports your knowledge in dispute resolution mechanisms, or in public procurement linked to arbitration with the State.<\/span><\/p>

c)<\/strong> To prove the quality of a lawyer or other professional, by a copy of the certificate issued by local or foreign university, with the corresponding certificate of registration in SUNEDU.\u00a0<\/p>

d)<\/strong> Have at least three (3) years of professional practice, computed from the date of tuition.\u00a0<\/p>

(e)<\/strong> Do not register more than three (3) exceptions declared to be founded by any arbitral institution, in public procurement processes or other matters, within two (2) years previous.\u00a0<\/p>

f)<\/strong> Demonstrate training in public procurement, arbitration and administrative law applicable to arbitrators, which is accredited by a university licensed by SUNEDU, graduate school, or programs conducted in agreement with these institutions. In the case of applicants to arbitrators in public procurement, will comply, as a minimum, with the requirements provided for in the General Law of Public Procurement, Regulations and standards that replace and \/ or modify it.\u00a0<\/p>

g)<\/strong> Having completed a specialization course in contract execution of public works, construction management or related subjects, taught by college, graduate school licensed by SUNEDU or in agreement with these.\u00a0<\/p>

h)<\/strong> Accredit professional prestige, moral and ethical, by a Sworn Statement certifying does not have disciplinary proceedings pending or sanctions in force imposed by their professional association, or by some record of the State; also, do not be linked in publications or on social networks to acts of corruption or scandals.<\/p>

\u00a0(i)<\/strong> File an Affidavit of not having criminal records, court or police. In case it is detected falsehood or inaccuracy in the information provided, it shall automatically cancel the registration, communicating this fact to the vocational high school for the corresponding actions.<\/p>

THE PROCEDURE FOR INCORPORATION TO THE NOMINATION OF THE ARBITRATOR<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

The selection and incorporation of arbitrators of the payroll institutional TMARC CENTRE FOR ARBITRATION & DISPUTE BOARDS responds to a process that seeks to ensure fairness, openness and the highest professional quality. This procedure is designed to promote meritocracy and transparency, ensuring that those who are incorporated to comply with the standards required by the practice of arbitration and, in his case, the public procurement.<\/p>\n

The first phase consists in the publication of an open call through the media officers of the institution, which allows all interested professionals to have the opportunity to participate on equal terms. Applicants must submit their resume accompanied by documentation proving your path, which will be evaluated according to the parameters defined in the Regulations of the Center. In the course of to apply to the payroll of public procurement, the evaluation will also focus the requirements provided for in the rules that regulate such subject matter.<\/p>\n

Article 328. Requirements for arbitrators in the field of public procurement<\/strong><\/p>\n

328.1. To be an arbitrator in the matter of recruitment to public, the following is required:<\/p>

(a) Form part of the payroll of an Arbitral Institution that is located in the REGAJU.<\/span><\/p>

(b) Comply with the requirements referred to in section 77.7 of the article 77 of the Law.<\/span><\/p>

c) Not be able to be arbitrators in accordance with what is stated in the article 327.<\/span><\/p>\n

328.2. To be sole arbitrator or chairman of the arbitral tribunal is required that the professional lawyer has studies specialization in administrative law, arbitration, and public procurement. Each specialization can be accredited through studies completed doctoral or master's degree in relevant subjects, or courses, or postgraduate courses offered by universities or professional associations in each of the aforementioned subjects or credit to undergraduate teaching in those subjects, at least two years or four semesters, or two hundred and forty academic hours.<\/p>\n

328.3. The parties may propose arbitrators different to those that form part of the payroll of the Arbitral Institution chosen, provided that they are a part of the payroll of an Arbitral Institution that is located in the REGAJU; in which case, the institution chosen by the parties can confirm or not the designation of the arbitrators made by the parties, giving the reasons for its decision. Such a decision can only be challenged by the referee before the higher court of arbitration of the Arbitral Institution.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
